When you apply for a position, your application data — including your name, contact details, CV, and any other materials you submit — will be shared with the employer or recruiter who posted the listing. By submitting an application, you consent to this sharing.

2.3 No guarantee of employment

Recruiter Theory connects job seekers with employers. We do not guarantee that you will receive interviews, offers, or employment as a result of using our platform. All hiring decisions are made solely by the employer.

3. Employers and recruiters

  • Handle applicant data in accordance with applicable data protection law, including the GDPR and UK GDPR where applicable
  • Use applicant data only for the purpose of evaluating applications for the listed role
  • Not share applicant data with third parties without the applicant’s consent

3.3 Compliance with employment law

You are solely responsible for ensuring that your job listings and recruitment practices comply with all applicable employment, equal opportunity, and anti-discrimination laws in your jurisdiction.

4. Prohibited conduct

You must not use Recruiter Theory to:

  • Post false, misleading, or fraudulent content
  • Discriminate against applicants or post listings that violate equal opportunity laws

5. Content ownership

You retain ownership of all content you submit to Recruiter Theory, including job listings, application materials, and profile information (“Your Content”).

6. Privacy and data protection

Your use of Recruiter Theory is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please read our Privacy Policy carefully to understand how we collect, use, and protect your personal data.

Recruiter Theory is built on the Job Boardly platform, operated by Glacier Systems Pty Ltd (Australia). Personal data submitted through Recruiter Theory is processed by Job Boardly as a data processor on behalf of Recruiter Theory. Further details are set out in our Privacy Policy.

If you are located in the European Economic Area (EEA) or United Kingdom (UK), you have additional rights under the General Data Protection Regulation (GDPR) and UK GDPR respectively. These are described in our Privacy Policy.

7. Intellectual property

All intellectual property rights in the Recruiter Theory platform, including its design, software, and branding, belong to Recruiter Theory or its licensors (including Job Boardly, operated by Glacier Systems Pty Ltd). You must not copy, reproduce, or create derivative works from the platform without our express written permission.

8. Disclaimers

Recruiter Theory is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law:

  • We do not guarantee that the platform will be uninterrupted, error-free, or secure at all times
  • We are not responsible for the accuracy, completeness, or legality of any job listings posted by employers
  • We are not a party to any employment contract or arrangement between job seekers and employers
  • We are not liable for any hiring or rejection decisions made by employers

9. Limitation of liability

To the maximum extent permitted by applicable law, Recruiter Theory shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of Recruiter Theory, including loss of data, loss of revenue, or loss of opportunity.

Our total liability to you for any claim arising out of or relating to these Terms or your use of Recruiter Theory shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £100 / €100 / USD $100.

Nothing in these Terms excludes or limits liability where it cannot lawfully be limited, including liability for fraud or death and personal injury caused by negligence.

10. Termination

We may suspend or terminate your access to Recruiter Theory if you breach these Terms or use the platform in a way that causes harm to others or to us.

You may stop using Recruiter Theory at any time. To delete your account or your content, please contact us at chris@munavu.com.

10.1 Dormant accounts

To comply with applicable data protection law, including the storage limitation principle under the GDPR and UK GDPR, we retain personal data only for as long as necessary.

If your account has had no activity for 12 months, we will send a warning email to your registered email address notifying you that your account has been flagged as dormant and is scheduled for deletion. If you do not log in within 30 days of that notification, your account and all associated personal data will be permanently deleted.

“Activity” means any login, profile update, job application, job posting, or other action taken through your account.

You can prevent deletion at any time before the 30-day response window closes by logging in. Once your account has been deleted, we are unable to recover your data.

10.2 Statement of reasons

Where we remove content, restrict your access to features, or suspend or terminate your account, we will provide you with a statement of reasons that includes:

  • The facts and circumstances on which the decision was based
  • Whether any automated tools were used in reaching the decision
  • Where applicable, information about how you may challenge the decision

This statement will be provided at or before the time the restriction takes effect, unless we are prohibited from doing so by applicable law.

11. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will notify you by email or by posting a notice on Recruiter Theory. Continued use of Recruiter Theory after changes take effect constitutes your acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Recruiter Theory is established. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

13. Ranking, promoted listings and advertising

Recruiter Theory may offer employers the ability to pay to promote their job listings above other listings. Promoted listings are displayed more prominently than non-promoted listings and are clearly labelled as “Promoted” or “Sponsored”.

Non-promoted listings are displayed in reverse chronological order (most recent first) unless otherwise indicated.

13.2 Advertising

Recruiter Theory may display advertising provided through Google Ads or similar third-party advertising services. Advertisements are clearly labelled as “Ad” or “Sponsored” and are distinct from job listings and other organic content. The advertiser responsible for each advertisement is identified by the advertising platform in accordance with applicable law.

For more information about why you are seeing a particular advertisement, you can use Google’s Ad Transparency Centre.

14. Digital Services Act

If Recruiter Theory qualifies as a hosting service or online platform under Regulation (EU) 2022/2065 (the “Digital Services Act” or “DSA”), the following provisions apply to recipients of the service located in the EU.

14.1 Reporting illegal content

If you become aware of content on Recruiter Theory that you believe to be illegal under EU law or the law of any EU member state, you may submit a notice to us at:

Email: chris@munavu.com

Your notice should include:

  • A sufficiently substantiated explanation of why you believe the content is illegal
  • A clear indication of the location of the content (e.g. the URL or listing title)
  • Your name and contact details (unless you wish to submit the notice anonymously)

We will acknowledge receipt of your notice, take action where appropriate, and inform you of our decision and the reasons for it.

14.2 Challenging our decisions

If you disagree with a decision we have made in response to a notice of illegal content, or a decision to remove content or restrict your account, you may challenge it by contacting us at chris@munavu.com, setting out the grounds for your challenge.

For transparency, Glacier Systems Pty Ltd — which operates the Job Boardly platform on which Recruiter Theory is built — has appointed DataRep as its EU legal representative under Article 13 of the DSA. DataRep can be contacted at digitalrequest@datarep.com (quote “Job Boardly” in the subject line), via the online webform at www.datarep.com/data-request, or by post at DataRep, The Cube, Monahan Road, Cork, T12 H1XY, Republic of Ireland.

If Recruiter Theory qualifies as a hosting service or online platform under the DSA and is established outside the EU, Recruiter Theory is responsible for designating its own EU legal representative under Article 13 of the DSA in respect of its own activities. The DataRep appointment described above applies only to Glacier Systems Pty Ltd’s role as platform provider.
